Re: Tariff Notice No. 607

On 1 December 2006 , the Commission received an application by MTS Allstream, under cover of Tariff Notice 607, requesting the Commission's approval to increase the rate charged for a local payphone call originating at public and semi-public telephones.

Commission staff notes that in Regulatory framework for second price cap period , Telecom Decision CRTC 2002-34, 30 May 2002 (Decision 2002-34) the rates for public and semi-public pay telephones were frozen until the Commission conducted a policy proceeding on this service.   Commission staff notes that it disagrees with MTS Allstream's claim that the conditional rate constraints established in Decision 2002-34 have been superseded by Access to pay telephone service , Telecom Decision 2004-47, as staff is of the view that the Commission did not make a determination with respect to pay telephone rates in this Decision.  

Commission staff further notes that in Extension of the price regulation regime for Aliant Telecom Inc., Bell Canada, MTS Allstream Inc., Saskatchewan Telecommunications and TELUS Communications Inc ., Telecom Decision CRTC 2005-69,16 December 2005 (Decision 2005-69), the Commission extended the current price cap regime without changes for Aliant Telecom Inc. (Aliant Telecom), Bell Canada, MTS Allstream Inc. (MTS Allstream), Saskatchewan Telecommunications (SaskTel) and TELUS Communications Company (TCC) for a period of one year, to 31 May 2007.

Commission staff is of the view that it is premature for MTS Allstream to file this application since the Company's pay telephone rates are frozen until 31 May 2007 .   Consequently, this file is now closed.
