Ms. Donna L Robertson Re: Part VII application by Shaw Communications Inc. v. Concord Pacific Group Inc. and Novus Entertainment Inc. - seeking non-discriminatory access to multiple unit dwellings On 24 November 2006, Shaw Communications Inc. (Shaw) filed with the Canadian Radio-television and Telecommunications (CRTC) a Part VII application pursuant to the Telecommunications Act , the CRTC Telecommunications Rules of Procedure (the Rules) and the Broadcasting Distribution Regulations seeking non-discriminatory access to multiple unit dwellings developed by Concord Pacific Group Inc. (Concord) and enforcement of the undue preference and inside wire obligations of Novus Entertainment Inc. (Novus). Commission staff notes that Shaw identified TELUS Communications Company (TCC) in its application as the incumbent local exchange carrier in the buildings in question. Therefore, Shaw is directed to serve a copy of the application on TCC, by 8 December 2006 . In its application, Shaw proposed that the Commission extend the time for Concord and Novus to provide their Answer and Shaw to provide its Reply beyond the timelines set out in the Rules. Commission staff considers that it is acceptable to grant an extension. Therefore, parties may file comments in response to the Application by 16 January 2007 , serving a copy on parties to the proceeding. Shaw may file reply comments by 26 January 2007 , serving a copy on parties to the proceeding.
