Re: Tariff Notice 46 - Competitive Local Exchange Carrier General Tariff

On 27 October 2006 , the Commission received an application by Execulink Telecom (Execulink), under cover of Tariff Notice 46, in which the company proposed to introduce its Competitive Local Exchange Carrier (CLEC) General Tariff.

Commission staff notes that while Execulink is a small incumbent local exchange carrier (ILEC), it has recently registered as a proposed CLEC under the same corporate name.   Commission staff notes that Execulink has used CRTC 25420 for the General Tariff related to its small ILEC operations. Commission staff notes that Execulink should have used the next tariff number for its CLEC General Tariff, namely CRTC 25421, in the tariff block (CRTC 25420 to 25429) it was assigned, rather than not using any tariff number for its CLEC operations.

Commission staff also notes that where the company indicated the word "FILE" instead of a proposed rate, it should have either indicated "Not Applicable" if the company does not plan to offer the service in a particular territory or it should have completely removed the information related to the provision of the service in that territory.

Commission staff further notes that the numbering of the company's proposed General Tariff should be consistent throughout the entire document.

Commission staff finally notes that, as outlined in the CLEC Model Tariff User Guide and in the Telecommunications Rules of Procedure , the words "Proposed Tariff Page" should be indicated at the top of each page, not at the bottom. The company should also have indicated the CRTC authority at the bottom of each page.

Consequently, this application is closed.

However, the Commission is open to examining a new application from the company that would address the items noted above.   The application must be filed under cover of a new tariff notice.   The company may contact Joëlle Bernier at (819) 994-0551 should it require further information.
