Re:    CLEC rates for interconnection

In Follow-up to Trunking arrangements for the interchange of traffic and the point of interconnection between local exchange carriers, Telecom Decision CRTC 2004-46 , Telecom Decision CRTC 2006-35, 29 May 2006, the Commission approved amended definitions for the local interconnection regions (LIRs) proposed by each incumbent local exchange carrier (ILEC) and approved, on a final basis, the interconnection rates for the termination of competitive local exchange carrier (CLEC) intra-LIR traffic for each ILEC.   The Commission also modified the rate structure to reflect 10 percent traffic imbalance increments.   Further, the Commission determined that these rates were to take effect on 29 May 2006 .

In this regard, Commission staff notes that in Regulatory framework for second price cap period , Telecom Decision CRTC 2002-34, 30 May 2002, the Commission directed each ILEC to issue tariff pages by 1 June of each year incorporating adjustments to Category I Competitor Service rates to reflect the application of a constraint equivalent to the rate of inflation less a productivity factor (the I-X constraint).   Pursuant to this decision, the ILECs have issued tariff pages effective 1 June 2006 , reducing the rates for intra-LIR traffic.

In MTS Allstream and Bell Canada - Part VII applications regarding 900 service , Telecom Decision CRTC 2006-48, 3 August 2006, the Commission determined that the consumer safeguards for 900 service should be of general application and cover all 900 service providers and 900 service content providers as well as all relationships between 900 service content providers, 900 service providers, local exchange carriers, and clearing houses that involve 900 service.   Accordingly, the Commission determined that the CLEC Model Tariff should be modified to explicitly include the same Commission-mandated consumer safeguards related to 900 services that apply to the large ILECs.

In Local Competition , Telecom Decision CRTC 97-8, 1 May 1997 , the Commission considered that it was in the public interest to require CLECs to provide interconnection for wireless service providers and equal access for all interexchange service providers, at terms and conditions equivalent to those contained in the ILECs' tariffs.   The Commission required all CLECs to file proposed tariffs for interconnection and to justify any departure from the terms and conditions contained in the ILECs' tariffs.

In Implementation of price regulation for Télébec and TELUS Québec , Telecom Decision CRTC 2002-43, 31 July 2002 , the Commission directed Société en commandite Télébec (Télébec) and TELUS Communications (Québec) (TCQ) to issue tariff pages by 1 August of each year incorporating adjustments to Category I Competitor Service rates to reflect the application of the I-X constraint.

In Disposition of funds in the deferral accounts , Telecom Decision CRTC 2006-9, 16 February 2006 , the Commission directed Télébec to suspend the application of the I-X constraint on its Competitor Services and its Other Capped Services baskets, effective 1 August 2006 , in order to minimize the negative impact of rate reductions on Télébec's deferral account.

Pursuant to these decisions, TCQ issued tariff pages, effective 1 August 2006 , reducing its Competitor Service rates.

Accordingly, CLECs are required to file within 30 days of the date of this letter, proposed tariffs, effective on the dates indicated above, to reflect the ILECs interconnection rates or to file proposed rates with cost justification for any departures from the ILECs' interconnection rates.   To assist CLECs with their required filings, it is noted that revised interconnection rates, by province, can be found on the CRTC website as part of the CLEC Model Tariff Version 27.

Moreover, CLECs are required to evaluate the requirements for rebates going forward from the effective dates indicated above, based upon the differences between the final rates approved by the Commission and the rates charged to customers in any price cap year, and to issue those rebates to customers.   To assist CLECs with this process, a table setting out the applicable rates for intra-LIR traffic for each ILEC can be found in Appendices to this letter.
