Re: CLEC rates for interconnection
In Local Competition , Telecom Decision CRTC 97-8, 1 May 1997, the Commission considered that it was in the public interest to require competitive local exchange carriers (CLECs) to provide interconnection for wireless service providers and equal access for all interexchange service providers, at terms and conditions equivalent to those contained in the incumbent local exchange carriers' (ILECs') tariffs. The Commission required all CLECs to file proposed tariffs for interconnection and to justify any departure from the terms and conditions contained in the ILECs' tariffs.
In Regulatory framework for second price cap period , Telecom Decision CRTC 2002-34, 30 May 2002 (Decision 2002-34), the Commission directed each ILEC to issue tariff pages by 1 June of each year incorporating adjustments to Category I Competitor Service rates to reflect the application of a constraint equivalent to the rate of inflation less a productivity factor.
Commission staff has recently uncovered that certain rates found in the CLEC Model Tariff Version 25 were not updated as they should have been pursuant to the Commission's determination in Decision 2002-34.
Accordingly, CLECs are required to update their tariffs to reflect the revised ILECs interconnection rates or to file proposed rates with cost justification for any departure from the ILECs' interconnection rates. These changes to the interconnection rates are to be made in addition to the changes outlined in the Commission letter dated 26 July 2006 and associated with CLEC rates for interconnection.
Moreover, CLECs are required to evaluate the requirements for rebates going forward from the effective dates indicated in the attachments to this letter, based upon the differences between the rates approved by the Commission and the rates charged to customers in the applicable price cap years, and to issue those rebates to customers. To assist CLECs with this process, tables setting out the applicable rates for each price cap year can be found in the Appendices to this letter.
