RE:   Associated with Aliant Telecom Tariff Notice No. 203

On 26 June 2006 , the Commission received an application by Aliant Telecom Inc. (Aliant Telecom) under cover of Tariff Notice 203 (TN 203), which proposes to amend Aliant Telecom's tariff CRTC 21491, item 612, Competitor Digital Network Service, to introduce a link charge and clarify when link charges would be applied.   Aliant Telecom indicated that the cost support for this service was submitted by Bell Canada on 2006 03 24, and adopted by Aliant Telecom by letter 2006 05 11.

Commission staff notes that Bell Canada's cost study submission was filed in response to Commission interrogatories associated with a Part VII Application by Rogers Wireless Partnership: Clarification on the Applicability of Retail Digital Network Access (DNA) Link Charges on Competitor Digital Network (CDN) Facilities.   Commission staff is of the view that it was premature of Aliant Telecom to file an application to introduce a link charge under item 612 prior to the Commission rendering its decision on Rogers Part VII application.  

Consequently, this application is closed.   However, the Commission is open to examining a new application from Aliant Telecom that addresses the above issue after the Commission has rendered its decision on Rogers Part VII application. The application must be filed under cover of a new tariff notice.   The company may contact Doug Thurston at (819) 997-4579 should it require further information.
