Mr. Dallas Yeulett Dear Ms. Tayler and Messrs Angel and Yeulett: Subject: Part VII Application for Relief with respect to Northwestel's Internet Gateway Service This is further to the letter dated 26 June 2006 from Northern Television Systems Ltd. (WHTV) and Polarcom (collectively, the "Yukon Independent Internet Service Providers" (the YIISPs)) requesting that the Commission ignore Northwestel Inc.'s (Northwestel) response dated 23 June 2006 on the basis that the response was filed out of process after the close of the proceeding. Commission staff notes that, b y letter dated 31 May 2006 , the YIISPs were advised that they could provide comments relating to the additional information and response to interrogatories provided by Northwestel, no later than 13 June 2006 . Commission staff also notes that the YIISPs filed their comments on 13 June 2006 and that Northwestel, by letter dated 23 June 2006 , filed comments in response to the YIISPs' 13 June 2006 comments. Commission staff notes that the final date for submissions by the YIISPs was set at 13 June 2006 and that no further opportunity for comment by Northwestel was contemplated following that date. Commission staff therefore considers that Northwestel's response, dated 23 June 2006 , was filed out of process. Accordingly, Northwestel's response dated 23 June 2006 will not form part of the record of this proceeding and will therefore not be considered by the Commission in its deliberations.
