Re:    Tariff Notice 45

On 7 June 2006 , the Commission received an application by Execulink Telecom Inc. (Execulink) under cover of Tariff Notice 45 in which the company proposed increases to its Call Display service and ValuePac Basic Residential service.

Commission staff notes that pursuant to Revised regulatory framework for the small incumbent local exchange carriers, Telecom Decision 2006-14, 29 March 2005 , (Decision 2006-14); the above services are assigned to the Fourth Basket of services.   In Decision 2006-14, the Commission concluded that rates for services in the Fourth Basket will be allowed to increase up to any rate approved by the Commission for the same service and that for proposed increases that are more than previously approved rates an economic study is required.

Commission staff notes that Execulink, in its application, did not provide reference to any approved rate by the Commission for its proposed rate increases or an economic study to support the proposed rate increases.

Consequently this application is closed.   However, the Commission is open to examining a new application from the company containing the required information pursuant to Decision 2006-14.   The application must be filed under cover of a new tariff notice.
