Re: Revised regulatory framework for the small incumbent local exchange carriers, Telecom Decision CRTC 2006-14

In Revised regulatory framework for the small incumbent local exchange carriers , Telecom Decision CRTC 2006-14, 29 March 2006 (Decision 2006-14 ) , the Commission directed the small incumbent local exchange carriers (SILECs) to show cause by 1 June 2006 , as to why the determinations made in Regulatory framework for voice communication services using Internet Protocol , Telecom Decision CRTC 2005-28, 12 May 2005 (Decision 2005-28 ) should not apply to them.

On 4 May 2006 , in Order in Council P.C. 2006-305 (Order in Council), the Governor in Council, pursuant to subsections 12(1) and 12(5) of the Telecommunications Act , referred Decision 2005-28 back to the Commission for reconsideration. The Commission was directed to complete its reconsideration of Decision 2005-28 within 120 days of the date of the Order in Council. In Telecom Public Notice CRTC 2006-6, Reconsideration of Regulatory framework for Voice communication services using Internet Protocol , Telecom Decision CRTC 2005-28 ( P. N. 2006-6 ) , the Commission invites comments pertaining to the reconsideration of Decision 2005-28 , as well as any other matters that may be pertinent to the regulatory framework for VoIP services.

In a letter dated 24 May 2006, the Canadian Independent Telephone Company Joint Task Force, on behalf of the members of the Canadian Alliance of Publicly-owned Telecommunications Systems (CAPTS), NorthernTel, Limited Partnership, the members of the Ontario Telecommunications Association (OTA), the members of Société d'administration des tarifs d'accès des télécommunicateurs (SATAT), and the members of Association des Compagnies de Téléphone du Québec (ACTQ) that are not members of SATAT, requested that the Commission extend the date of submission of the SILECs show cause response to Decision 2005-28 by 90 days following the rendering of the Commission's decision related to P.N. 2006-6 .

In view of the matters currently under review by the Commission, Commission staff notes that it is more relevant for the SILECs to file their show cause after the Commission has made its decision pursuant to Order in Council. Commission staff is however of the view that it would be sufficient to extend the submission deadline by 60 days after the Commission has made its decision pursuant to Order in Council.

Commission staff hereby extends the deadline for SILECs to submit show cause response to Decision 2005-28 to 60 days after the Commission has rendered its decision related to P.N. 2006-6 .
