Re: Show cause relating to the publication of summarized competitor quality of service results   

The purpose of this letter is to initiate a show cause process relating to the publication on the Commission's website of a summary of parts of the incumbent telephone companies (ILECS) competitor quality of service (Q of S) reports, which are filed with the Commission quarterly.   It is envisaged that summaries of the reports for the first three quarters of the competitor Q of S regime, the first dated June 2005, that have already been filed with the Commission, would be posted on the website immediately.   Thereafter, subsequent summaries would be posted quarterly, following the filing by the ILECs of their competitor Q of S Reports.

The information making up the summaries is described below and would be drawn from data that is filed by the ILECs in accordance with the determination made in Finalization of quality of service rate rebate plan for competitors , Telecom Decision CRTC 2005-20, 31 March 2005 :

" The ILECs are required to file with the Commission, and provide to the relevant competitor, all supporting details associated with the determination of the Q of S results and the calculation of the rate rebate amounts."

The Commission recognizes that the competitor Q of S reports contain data which has been filed in confidence by the ILECs, pursuant to section 39 of the Telecommunications Act.   However, the Commission also notes that not all the information contained in the filed competitor Q of S reports, would be posted on the website and that the information that would be posted would be presented in an aggregated format.

As mentioned above, in the future it would be t he Commission's intention to post subsequent summaries of the competitor quality Q of S information on a quarterly basis, unless parties can demonstrate significant changes in circumstances with respect to specific direct harm, or the public interest to be served, caused by posting these summaries, thereby justifying the Commission to reconsider this approach.   Parties wishing to make submissions on this matter are requested to do so by 31 May 2006 .

In light of the above, the show cause process relates to the disclosure of a summary of competitor Q of S information limited to address only those matters set out below:

  • Total number of opportunities in a quarter for an ILEC to meet Q of S indicators for all competitors with activity in that quarter; 

  • Total number of opportunities in a quarter that an ILEC actually met for all competitors; and 

  • Aggregated rate rebate payable in a quarter to all competitors, rounded to the nearest $1000.
