Dear Ms. Malherbe:

Re:   Tariff Notice 51 - Type 4 Digital Network Access service

On 12 April 2006 , the Commission received an application by Cochrane Telecom Services of the Corporation of the Town of Cochrane (Cochrane), under cover of Tariff Notice 51 (TN 51), in which the company proposed revisions to Section 900, Item 3 - Digital Network Access (DNA) services of its General Tariff in order to introduce Type 4 DNA services.

Commission staff notes that Cochrane indicated that the rates proposed in TN 51 are based on the Bell Canada General Tariff, Item 5020 - Ethernet Access services.

Commission staff notes that Cochrane has proposed rates for certain services that are not offered by Bell Canada in its Ethernet services tariff.   More specifically:

  1. For Ethernet Access services offered on a non-contracted basis; 
  2. For Ethernet Access services offered at speeds of "xDSL to 5mbps"; and
  3. For Ethernet Intra-Exchange service.

Commission staff also notes that Cochrane has proposed rates for certain services that differ from the rates approved for Bell Canada for the same services.   More specifically:

  1. A monthly recurring rate for Ethernet Link service; and
  2. A service charge for changes made to network paths after completion of the initial installation.

Commission staff further notes that Bell Canada's provision of Ethernet Access services may include Customer Premise Equipment (CPE) or exclude it, at the customer's discretion.   Cochrane's proposed Ethernet Access monthly rates are based on Bell Canada 's Ethernet Access rates including CPE, whereas Cochrane's proposed Ethernet Access service charges are based on Bell Canada 's Ethernet Access service charges excluding CPE.   Commission staff notes that the company's proposed tariff should be clear as to whether Cochrane intends to offer Ethernet Access services in conjunction with CPE or not, or whether it intends to offer both options as Bell Canada does.

Finally, Commission staff notes that Cochrane did not provide a rationale nor did it provide costing information where its tariff proposal differs from the tariff it is based on, namely Bell Canada Item 5020 - Ethernet Access services.

Consequently, this application is closed.   However, the Commission is open to examining a new application from Cochrane that would address the items noted above.   The application must be filed under cover of a new tariff notice.   The company may contact Joëlle Bernier at (819) 994-0551 should it require further information.
