Dear Ms. Tayler and Messrs Angel and Yeulett:

Subject: Part VII Application for Relief with respect to Northwestel's Internet Gateway Service

By letter dated 24 February 2006, Commission staff issued questions to Northwestel Inc. (Northwestel) on the Part VII application submitted jointly by Northern Television Systems Ltd. (WHTV) and Polarcom (collectively, the "Yukon Independent Internet Service Providers" ("YIISPs")) dated 29 November 2005.   Commission staff also indicated in its letter that additional questions may be required and that further process would be established to provide the opportunity for further comments and reply on this application.

Northwestel is requested to provide its response to the following additional questions:

  1. Provide a Phase II cost study for I-Gate service (Gateway Service) for each sustained usage bandwidth identified in Attachment 1 of Northwestel's submission of 20 January 2006 , using the most current information.   Include all assumptions, demand forecasts and the rationale for the rates.  
  2. Commission staff notes the YIISPs' submission that Gateway Service is a wholesale Internet service that the YIISPs require from Northwestel to transport their Internet traffic and to connect to the Internet backbone, in order to be able to compete, in the retail IS market, with Northwestel.   In this connection, Commission staff notes the Commission's description of Competitor Services in, for example, Regulatory framework for second price cap period , Telecom Decision CRTC 2002-34, 30 May 2002 (Decision 2002-34).    

    a.   With reference to the description of Competitor Services in Decision 2002-34, provide, with reasons, Northwestel's view on whether its Gateway Service is a competitor service and, if so, its views on the appropriate mark-up for this service.  

    b.   Identify the non-retail customers who currently subscribe to Gateway Service.

Northwestel is to file its response by 8 May 2006 serving a copy on the YIISPs.   Northwestel may, as part of its response, also provide comments relating to the additional information provided in response to the questions set out in Commission staff's letter dated 24 February 2006 . The YIISPs may provide comments relating to the additional information and comments provided by Northwestel by no later than 15 May 2006 serving a copy on Northwestel.
