Re:  Tariff Notice 3

On 20 January 2006, the Commission received an application by ISP Telecom, under cover of Tariff Notice 3, in which the company proposed revisions to its General Tariff in order to incorporate the rates found in the Competitive Local Exchange Carrier Model Tariff Version 24.

Commission staff notes that where the company indicated the word "FILE" instead of a proposed rate, it should have indicated "Not Applicable" if the company does not offer the service or it should have proposed a rate if it offers the service.

Commission staff also notes that the proposed effective date for these revisions should be 1 June 2005, since the rates for the same interconnection services were approved for the ILECs effective 1 June 2005.

Commission staff further notes that, on the proposed pages, the company did not show that it was replacing existing pages, nor are there any symbols showing the company's changes on each page. Moreover, the proposed Check Page should be modified accordingly.

In light of the above, Commission staff is returning ISP Telecom's application. Consequently, this application is closed.

However, the Commission is open to examining a new application from the company that would address the items noted above. The application must be filed under cover of a new tariff notice.
