Deadline to commence operations

The Commission approves in part the application by O.K. Radio Group Ltd. (OK Radio) for an extension of the time limit to commence the operation of the transitional digital radio undertaking to serve Victoria, associated with CKKQ-FM Victoria (CKKQ-DR-1), authorized in Transitional digital radio undertaking in Victoria, Broadcasting Decision CRTC 2004-121, 19 March 2004 (Decision 2004-121).

OK Radio requested an extension of time to 19 March 2007 to implement citing the uncertainty of the status of digital broadcasting in Canada. The Commission notes, however, that the date proposed by the applicant would extend beyond the expiry of the licence in question. The Commission does not grant extensions for the purpose of implementation beyond the expiry of licence terms.
3. In light of the above, the Commission extends, to 31 August 2006, the deadline by which the operation of this transitional digital radio undertaking must commence. This is the final extension to be granted by the Commission with respect to the implementation of this undertaking.
4. The licence for this undertaking will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. The authority granted in Decision 2004-121 will become null and void should the licensee fail to meet the new implementation deadline set out above.
