The Commission has received the following application. The deadline for submission of interventions/comments is 6 December 2005.

Application by Jim Pattison Broadcast Group Ltd. (the general partner) and Jim Pattison Industries Ltd. (the limited partner), carrying on business as Jim Pattison Broadcast Group Limited Partnership (JPBG) to amend the licence of television programming undertaking CFJC-TV Kamloops.
|

The licensee proposes to delete the condition of licence relating to its affiliation with the Canadian Broadcasting Corporation which reads:

"The licensee shall operate this broadcasting undertaking as an affiliate of the English-language television network operated by the Canadian Broadcasting Corporation" (CBC) (as stated in Broadcasting Decision CRTC 2004-373).
|
|
The applicant states that its ability to provide local service is based upon a joint sales agreement with Global Communications Limited's CHBC-TV Kelowna (Global)1 . The continuation of this agreement, according to the application, is contingent on the disaffiliation of CFJC-TV from the CBC.
|
|
Letters from the CBC supporting the application are included in the file. They state that disaffiliation is consistent with its current strategy of enhancing the availability of its full English television service for viewers residing in areas served by affiliates.
|
|
The CBC make it clear that, for the first time in a disaffiliation matter, it will not build off air rebroadcasting transmitters to ensure the availability of a CBC signal due primarily to budgetary constraints. The Commission notes that, over the station's full coverage area, approximately 7% of the residents would lose service from the CBC. The CBC has pointed out that section 17 of the Broadcast Distribution Regulations will ensure the carriage of a CBC owned and operated station on the basic service of class 1 and 2 cable licensees. According to the CBC, through these regulatory requirements and the current penetration of Direct-to-Home services in the area, the percentage of the Kamloops market that has access to its full schedule would increase from 31% to 95%.

The applicant states that, if the proposed disaffiliation is approved, it will maintain the minimum level of local programming and pertinent conditions of licence as stated in Broadcasting Decision CRTC 2004-373.
