Telecom Order CRTC 2005-50

  Ottawa, 10 February 2005

TELUS Communications Inc.

  Reference: Tariff Notice 164

Primary inter-exchange carrier processing charges

1.

The Commission received an application by TELUS Communications Inc. (TCI), dated 17 January 2005, to revise its competitive local exchange carriers (CLECs) General Tariff item 302.4, Primary Interexchange Carrier (PIC) Processing, in order to reflect the rates approved for the incumbent local exchange carriers (ILECs) in Primary inter-exchange carrier processing charges review, Telecom Decision CRTC 2004-72, 9 November 2004 (Decision 2004-72).

2.

PIC processing rates apply when an interexchange service provider (IXSP) requests that a local exchange carrier (LEC) either establish or change the PIC selection associated with a LEC's customers access lines.

3.

TCI requested that the PIC processing per network access service (NAS) rates take effect as of 20 March 2003 and that the rates for the remaining PIC processing components take effect as of 9 November 2004.

4.

In Local competition, Telecom Decision CRTC 97-8, 1 May 1997, the Commission determined that it was in the public interest to require CLECs to provide interconnection to all IXSPs and wireless service providers, at terms and conditions that were equivalent to those contained in the ILECs' tariffs. The Commission required all CLECs to file proposed tariffs for interconnection, justifying any departure from the terms and conditions contained in the ILECs' tariffs.

5.

The Commission notes that the proposed rates conform to those approved for the ILECs in Decision 2004-72.

6.

In Decision 2004-72, the Commission considered it appropriate for the ILECs to adopt the lower cost-based rates for the PIC processing charge per NAS, on a final basis, effective 20 March 2003. The remaining PIC processing rates were made effective the date of the Decision.

7.

The Commission notes that TCI's tariff includes a note indicating that the rates are approved on a final basis. The Commission further notes that the rates for the CLECs' tariffs remain interim in order that any required changes to their rates will ensure that they remain equivalent to those of the ILECs on the appropriate effective date.

8.

In light of the above, the Commission approves on an interim basis TCI's application with the following amendment:

  • In item 302.4, Primary Interexchange Carrier (PIC) Processing, replace the note with the following: "The PIC processing charge, per NAS, takes effect 20 March 2003. All remaining PIC components take effect 9 November 2004".

9.

The PIC processing charge per NAS is effective as of 20 March 2003. The remaining PIC processing rates are effective as of 9 November 2004. TCI is to issue revised tariff pages reflecting the amendment.

10.

The Commission directs TCI to provide refunds retroactive to 20 March 2003 for the PIC processing charge per NAS.
