Multi-Element Plan (MEP) service charges

The Commission received an application by TELUS Communications Inc. (TCI), dated 5 October 2005, under Tariff Notice 4239 (TN 4239), proposing revisions to General Tariff item 110, Multi-Element Plan (MEP) service charges, in British Columbia.

TCI proposed to revise the descriptions of the Office Connection and Field Connection elements in the tariff to reflect how the tariff is actually applied. TCI indicated that the Office Connection charge was applicable regardless of whether or not a field visit was required.

TCI also proposed revisions to clarify that a Data Processing charge was applicable for each order for work done in receiving a customer's request, that an Office Connection charge was applicable for each line for work done in TCI's central office to connect a customer's exchange network access line to TCI's network, and that a Field Connection charge was applicable for each line for work done at a customer's premises to connect a customer's exchange network access line to a TCI demarcation point for interconnection between TCI's network and the customer's premises wiring.

TCI requested the Commission's ratification, pursuant to subsection 25(4) of the Telecommunications Act, for the charging of the existing approved Office Connection and Field Connection rates in British Columbia for the period from 12 March 2001 to the approval of the TN 4239 application.

TCI indicated that in Tariff Notice 4117 (TN 4117), filed with the Commission on 20 November 2000 and approved in Order CRTC 2001-95, 2 February 2001 (Order 2001-95), it had initially proposed to restructure its MEP service charges by disaggregating the service charges into three independent work-function elements: Data Processing, Office Connection and Field Connection. TCI indicated that it only recently realized that in TN 4117, it had inadvertently not updated the respective descriptions of the Office Connection and Field Connection elements to correspond with the proposed rate restructure and the intended manner that the associated charges would apply.

TCI indicated that its intent under TN 4117 was that the service charge payable by a customer would continue to include one or more of the multi-element service charges under the proposed rate structure breakdown, and in particular, that the Office Connection charge element would apply to an installation regardless of whether or not a field visit was required.

TN 4239 was approved on an interim basis in Telecom Order CRTC 2005-353, 18 October 2005.

The Commission did not receive any comments with respect to this application.
 

Commission's analysis and determination

The Commission notes that TCI indicated that it has been applying the multi-element service charges consistent with the proposed tariff revisions.

The Commission considers that the proposed tariff revisions will ensure that the tariff is consistent with the actual charging practice. The Commission notes that while the descriptions of the Office Connection and Field Connection elements approved in Order 2001-95 did not clearly reflect the intended charging practice, supporting information submitted with that application did. The Commission considers that TCI's request for ratification for the charging of the existing approved Office Connection and Field Connection rates for the period from 12 March 2001 to the date of approval of TN 4239 is reasonable.

In light of the above, the Commission approves on a final basis TCI's application.

The Commission also ratifies the charging of the existing approved Office Connection and Field Connection rates for the period from 12 March 2001 to the effective date of this Order.
