Primary interexchange carrier processing rates

The Commission received an application by Shaw Telecom Inc. (Shaw), dated 17 December 2004, in order to reflect the rates approved for the incumbent local exchange carriers (ILECs) in Primary inter-exchange carrier processing charges review, Telecom Decision CRTC 2004-72, 9 November 2004 (Decision 2004-72).

PIC processing rates apply when an interexchange service provider (IXSP) requests that a local exchange carrier (LEC) either establish or change the PIC selection associated with a LEC's customers access lines.

Shaw requested that the rates take effect as of 9 November 2004.

In Local competition, Telecom Decision CRTC 97-8, 1 May 1997, the Commission determined that it was in the public interest to require competitive local exchange carriers (CLECs) to provide interconnection to all IXSPs and wireless service providers, at terms and conditions that were equivalent to those contained in the ILECs' tariffs. The Commission required all CLECs to file proposed tariffs for interconnection, justifying any departure from the terms and conditions contained in the ILECs' tariffs.

The Commission notes that the proposed rates conform to those approved for the ILECs in Decision 2004-72.

In Decision 2004-72, the Commission considered it appropriate to adopt the lower cost-based rates for the PIC processing charge per network access service, on a final basis, effective 20 March 2003. The remaining PIC processing rates were made effective the date of the Decision.

The Commission notes that in CLEC General Tariff, Telecom Order CRTC 2004-306, 8 September 2004, it approved on an interim basis Shaw's General Tariff effective the date of the order.

In light of the above, the Commission approves on an interim basis Shaw's application. The PIC processing charge per network access service is effective as of 8 September 2004. The remaining PIC processing rates are effective as of 9 November 2004.

The Commission directs Shaw to provide refunds retroactive to 8 September 2004 for the PIC processing charge per network access service.
