Re: Forbearance from regulation of local exchange services , Telecom Public Notice CRTC 2005-2 - Response to direction for disclosure of confidential information and further responses to interrogatories

In its response to the Commission's letter dated 8 September 2005 , Bell Canada has indicated that it is unable to file the following reports on the public record due to reasons of copyright:

•  Lemay-Yates Associates Inc., LYA Canadian Consumer Telecom & Cable TV Market Forecasts 2004 , August 2004   in response to Bell(MTS Allstream)20Jul05-202 PN 2005-2 ;

•  NBI/Michael Sone Associates, Canadian Local Telecommunications Services Market Report, 2004 Edition, November 2004 in response to Bell(CRTC)20Jul05-907 PN 2005-2 ; and

•  NBI/Michael Sone Associates, Canadian Mobile Wireless Communications Services Market Report , December 2004 in response to Bell (CRTC)20Jul05-907 PN 2005-2.

As indicated in the Commission letter dated 1 September 2005 , Bell Canada was directed to file these reports on the public record.   If Bell Canada wishes to rely on the information contained in these reports to support its positions with respect to this proceeding, then Bell Canada is required to file copies of the reports on the public record.

Alternatively, Bell Canada may choose to withdraw the reports, and all references to the reports from its submission of 22 June 2005 , and any subsequent submissions filed on the record of this proceeding.

Bell Canada is requested to advise the Commission staff of its decision with respect to this matter no later than noon on 19 September 2005 . If Bell Canada wishes to rely upon these reports to support its positions, Bell Canada is requested to file the reports on the public record no later than 21 September, 2005 .
