In the above noted tariff notice, TBayTel proposed to introduce Digital Network Access services.

Please find attached interrogatories addressing issues associated with this application.  

Responses to these interrogatories are to be filed with the Commission, by 10 August 2005 .   Responses are to be received by the Commission, and not merely sent, by this date.

The Commission expects this application to be disposed of within 45 business days of the date the Commission received the application.

Interrogatories

•  TBayTel submitted that its proposed rates were similar to Bell Canada 's rates for Digital Network Access Service. Some of the proposed rates are lower than Bell Canada 's rates for the non-contract option. Provide the company's rationale as to why the proposed rates are compensatory.

•  In " Direct toll and network access costing methodology for small incumbent local exchange carriers- Follow-up to decision 2001-756 " CRTC Telecom Decision CRTC 2005-3, 31 January 2005, the Commission approved trunking rates for the small independent local exchange carries (small ILECs) for interconnection with interchange carriers (IXCs).   These rates were set out in Appendix A of that Decision.   The Commission directed the small ILECs to file revised tariff pages to reflect these rates.

In its application, TBayTel proposed a retail rate for DS-1 link service of $54.00.   This retail rate is lower than the DS-1 link rate of $60.00 approved for IXC interconnection in Decision 2005-3.   Provide the company's rationale for proposing a retail rate lower than the rate that would apply to IXCs for the same service.
