RE:   TN 321 Price cap update

In Tariff Notice 321 filed 17 June 2005, Télébec requested approval of rate changes under the price cap update.   Télébec did not submit an economic study with its application because the proposed reductions do not reduce tariffs to levels below those approved for other undertakings.   Télébec stated that the tariffs for services covered by these reductions are higher than their costs.

Télébec submitted a comparative table of similar rates already approved for other undertakings.   For services that do not have a similar Commission-approved rate, Télébec indicated that an economic study will be filed within 10 days of the date of application.

Consequently, the Commission will be unable to render a decision within 10 days of the filing.

Commission staff notes that Télébec is required to file an economic study for all proposed rate reductions for other capped services.   The Commission will consider the entire application once all documents required to review the application are received before opening the file.

Télébec is directed to file all the requisite economic studies within 30 days of the date of this letter.

The Commission intends to dispose of the application within 45 days of receipt of the application in its entirety.
