Re:   MTS Allstream Tariff Notice 565 - Asymmetric Digital Subscriber Line (ADSL) Data Access

The Independent Members of the Canadian Association of Internet Providers (IMCAIP) requested, by letter dated 20 June 2005 , that the Commission delay any determination, interim or final, in respect of the MTS Allstream Inc. (MTS Allstream) Tariff Notice 565, Asymmetric Digital Subscriber Line (ADSL) Data Access, dated 1 June 2005 (TN 565). IMCAIP noted that the MTS Allstream application was not received by interested parties until 16 June 2005 . IMCAIP also noted that it had contacted MTS Allstream in order to request a meeting to pursue a "business negotiation" approach to arriving at a mutually agreeable tariff. 

On 22 June 2005 , Bell Canada submitted comments supporting IMCAIP's request and further indicated their interest in being party to any discussions amongst parties regarding TN 565. 

In light of the above, the process associated with TN 565 is suspended and the Commission will establish a revised process following advice by parties as to the outcome of their current discussions. Parties that have submitted comments to date will be given an opportunity to supplement their comments as appropriate as part of the revised process. Parties are encouraged to discuss the rates, terms and conditions associated with potential Competitor services in advance of filing a tariff application.
