Re: Part VII Application Regarding Local Winback Rules This is further to TELUS Communications Inc.'s (TELUS') application dated 24 March 2005, filed under Part VII of the CRTC Telecommunications Rules of Procedure , requesting that the Commission eliminate the local winback no-contact rules with respect to residential services in those cable serving areas within TELUS' incumbent local exchange carrier operating territory where Shaw Communications Inc. and/or its affiliates offer local telephone services now or in the future. Commission staff notes that Telecom Public Notice CRTC 2005-2 , Forbearance from regulation of local exchange services , 28 April 2005, (Public Notice 2005-2) initiated a proceeding which, among other things, invited comments on the appropriateness of a transitional regime that could provide incumbent local exchange carriers, including TELUS, with more regulatory flexibility prior to forbearance through lessening or removing competitive safeguards such as the local winback no-contact rules. In staff's view, the issues raised by TELUS, in its Part VII application with respect to the continued appropriateness of the no-contact restrictions in areas where an incumbent local exchange carrier is facing competitive entry will be addressed in the Public Notice 2005-2 proceeding. Staff further notes that the concerns raised by TELUS with respect to the no-contact restrictions and the Canadian Charter of Rights and Freedoms will be considered in the context of the Part VII application filed by Bell Canada and Saskatchewan Telecommunications on 25 April 2005. In light of the fact that the issues raised by TELUS in its Part VII application will be dealt with in other proceedings, Commission staff considers that no further action is required on the TELUS Part VII application and will close its file.
