Subject: Tariff Notice 34 - Residential and business basic local service

Dear Ms Lapierre:

On 15 April 2005 , the Commission received an application from La Compagnie de Téléphone de Lambton Inc. (Lambton), which proposed an increase to residential and business basic local service (BLS), effective 1 July 2005. More specifically, the company proposed the following:

  • a rate increase for residential individual lines from $18.13 to $24.55;

  • a rate increase for individual business lines from $33.13 to $34.23.

Lambton proposed that the new rates be effective 1 July 2005 .

Commission staff notes that Lambton's proposal to increase its residential BLS rate by $6.42 is contrary to the stipulation in paragraph 60 of Decision CRTC 2001-756 of 14 December 2001, Regulatory framework for the small incumbent telephone companies , in which the Commission indicates that monthly residential BLS rate increases should be limited to $4.00 per year.

Commission staff also notes that Lambton's proposal to have the new rates take effect on 1 July 2005 is contrary to paragraph 30 of the decision, which stipulates that rate increases are approved only once in a 12-month period, and Lambton's last BLS increase was approved.

Commission staff notes that the calculation tables to support the proposed rates do not reflect the rates in effect on 31 December 2004 .   For example, the table indicates that the residential service rate on 31 December 2004 was $23.79, while the rate in effect was $18.13.

Consequently, this application is now closed.

However, the company may submit a new application to the Commission to make up the above-mentioned deficiencies, pursuant to the directives in Decision 2001-756.   The application should be filed under cover of a new tariff notice.   Prior to submitting the new application, you are encouraged to contact Lizette Pépin by e-mail at lizette.pepin@crtc.gc.ca or by telephone at (819) 953-8735.
