RE:     Associated with Aliant Telecom Tariff Notice No. 156

On 31 March 2005 , the Commission received an application by Aliant Telecom under cover of Tariff Notice 156, which proposes to reduce rates for Megalink Service and Digital Exchange Access by eliminating the intra-exchange channel per DS1, as well as the associated link charge, that is provided as part of the Digital Network Access (DNA) portion of the service.   Tariff Notice 156 also proposed certain housekeeping changes to Digital Switch Service.

Commission staff is returning the company's application for the following reasons:

1.  The company has not explained why it is proposing to eliminate the intra-exchange channel per DS1 and the associated link charge from the DNA portion of DEA Service and Megalink Service and not from all services that use DNA.

2.  Commission staff notes that the summary sheet shows that Service Band Index (SBI) is higher than the Service Band Level (SBL) for Business Services and Other Capped services, contrary to the Commission's determinations in Regulatory framework for second price cap period , Telecom Decision CRTC 2002-34, 30  May 2002 , that t he SBI could not exceed the SBL.

Consequently, this file is closed.

However, since this application is part of the company's 2005 Price Cap filing, the company is requested to address the above issues by 15 April 2005 . The application must be filed under cover of a new tariff notice.
