Mr. Claude Beauregard Dear Mr. Beauregard: Re: Maskatel inc. Tariff Notice 06 - Primary Interexchange Carrier Processing Charges This is further to Maskatel inc.'s (Maskatel's) application filed under Tariff Notice 6 proposing amendments to its General Tariff item 302, Primary Interexchange Carrier (PIC) Processing. The company proposed rate changes in order to reflect the rates for this service that were approved for the incumbent local exchange carriers (ILECs) in Primary inter-exchange carrier processing charges review, Telecom Decision CRTC 2004-72, 9 November 2004 (Decision 2004-72). In Decision 2004-72, the Commission approved, on a final basis, Primary inter-exchange carrier (PIC) processing rates for the ILECs. Further, the Commission determined that the "PIC processing charge per network access service (NAS)" component was to take effect on 20 March 2003 and the revised rates for the remaining PIC components were to take effect the date of the decision. Pursuant to Local competition , Telecom Decision CRTC 97-8, 1 May 1997 , competitive local exchange carriers must file proposed tariffs providing for interconnection with other providers of telecommunications services that are equivalent to the terms and conditions contained in the ILECs' tariffs, justifying any departure there from. Commission staff notes that Maskatel's proposed rates for "PIC processing charge per NAS" in the operating territories of Prince Edward Island , Manitoba , New Brunswick , Saskatchewan and Newfoundland are inconsistent with those contained in the ILECs tariffs. Maskatel did not provide justification for its departure from the ILECs' rates. Further, the effective date for the "PIC process charge per NAS" should be 20 March 2003 . Consequently, this file is now closed. However, the Commission is open to examining a new application from the company which addresses the information noted above.
