Mr. David Palmer Dear Mr. Palmer: Subject: Request to withdraw Tariff Notice Nos. 762, 764, 767 and 774 On 18 August 2004 , Bell Canada requested approval to withdraw Tariff Notice (TN) Nos. 762, 764, 767, and 774 pertaining to arrangements provided by Bell West Inc. and referenced by contract numbers P3-1, P3-35, P3-40, P3-61 and P3-130. In making its request, Bell Canada relied on the Commission's finding in Follow-up to Telecom Decision CRTC 2002-76 - Location of the CSG and regulatory safeguards for affiliated carriers, Telecom Decision CRTC 2004-50, 22 July 2004 (Decision 2004-50) that Canadian carriers subject to common control with an ILEC will be required to comply with section 25 of the Telecommunications Act and other applicable provisions only with respect to agreements or arrangements entered into subsequent to the date of the decision. Commission staff notes that the above finding confirmed the Commission's preliminary view on this matter set out in Regulatory safeguards with respect to incumbent affiliates, bundling by Bell Canada and related matters , Telecom Decision CRTC 2002-76, 12 December 2002 (Decision 2002-76). Commission staff further notes that Bell Canada filed the above TNs based on directions in Decision 2002-76 that were separate and independent from the preliminary view subsequently confirmed in Decision 2004-50. Contrary to what Bell Canada appears to be suggesting, Commission staff considers that the Commission's finding in 2004-50 does not impact the filings previously made by the company pursuant to the relevant directions in Decision 2002-76.
