List of services within the scope of the proceeding on forbearance from the regulation of local exchange services

Erratum: Telecom Decision CRTC 2005-35 - Attachment 1

In List of services within the scope of the proceeding on forbearance from the regulation of local exchange services, Telecom Decision CRTC 2005-35, 15 June 2005 (Decision 2005-35) the Commission determined the list of services, included as Attachment 1 to Decision 2005-35, that are to be included in the scope of the proceeding on forbearance from the regulation of local exchange services1 (the List of Services). In this Erratum the Commission is making corrections to the List of Services. A corrected Attachment 1 is attached to this document with changes highlighted in bold italic.

The following provides a description of the corrections to Decision 2005-35 - Attachment 1.

The Commission, in paragraph 48 of Decision 2005-35, determined that competitor integrated voice messaging services (IVMS) were outside the scope of the proceeding. Due to an oversight in the preparation of the List of Services, non-competitor IVMS items for Bell Canada and Société en commandite Télébec (Télébec) were excluded from the List of Services. It was not the Commission's intention in Decision 2005-35 to exclude non-competitor IVMS from the List of Services. Accordingly, Bell Canada Tariff 6716, item 2025, excluding items 2025.4 and 2025.7, and Télébec Tariff 25140, item 3.3.20, excluding competitor components, have been added to the corrected List of Services in Attachment 1.

Due to an oversight in the preparation of the List of Services, Télébec Tariff 25140, item 4.1 was inadvertently included in, and item 3.3.18 was inadvertently omitted from, the List of Services. Accordingly, item 4.1 has been removed from, and item 3.3.18 has been added to, the List of Services in the corrected Attachment 1.

Due to a clerical error in the preparation of the List of Services, Saskatchewan Telecommunications (SaskTel) Tariff 21411, item 100.10 was inadvertently mislabelled as Network Access Service and included in the List of Services. Accordingly, SaskTel Tariff 21411, item 100.10, correctly identified as Rate Group Classification, has been removed from the List of Services in the corrected Attachment 1 as it does not contain any services which fall within the scope of this proceeding.

Similarly, SaskTel's Tariff 21411, items 110.10 and 110.12 were inadvertently omitted from the List of Services. Accordingly, SaskTel items 110.10 and 110.12 have been added to the List of Services in the corrected Attachment 1. The Commission notes that, as with all services listed in Attachment 1, any items within these tariffs which fall within the description of generic service charges and/or construction charges as discussed in Decision 2005-35 remain outside of the scope of this proceeding.

The Commission notes that new services that may fall within the definition of local exchange services and hence within the scope of this proceeding, such as Bell Canada Tariff 6716, item 7020, have been offered subsequent to the issuance of Decision 2005-35. The Commission considers that the List of Services set out in Decision 2005-35 reflects those services that fall within the definition of local exchange services at a point in time. The Commission considers that the framework for local forbearance that results from this proceeding will apply to all local exchange services that fall within the definition of local exchange services set out in Public Notice 2005-2, including those local exchange services which were/are tariffed subsequent to the issuance of Decision 2005-35. An applicant seeking forbearance pursuant to the local forbearance framework determined in this proceeding may include any such local exchange services in its application.
