The Commission approves the application by the Canadian Broadcasting Corporation (CBC) to amend the broadcasting licence for the television programming undertaking CBUT Vancouver, in order to operate transmitters in Kelowna, Braeloch, Penticton, Vernon, Oliver, Salmon Arm, Enderby and Celista, British Columbia1.

Residents of these communities currently receive some CBC television programming from CBC affiliate CHBC-TV Kelowna and its transmitters. In CHBC-TV Kelowna - Licence amendment, Broadcasting Decision CRTC 2005-80, of today's date, the Commission approves an application by Global Communications Limited to amend the broadcasting licence for CHBC-TV Kelowna, in order to permit CHBC-TV to disaffiliate from the CBC's English-language television network at such time as the CBC implements the transmitters approved in the present decision. These transmitters will replace the CBC programming services formerly provided by CHBC-TV, and will provide the full CBC English-language television network and regional service to residents of Kelowna, Braeloch, Penticton, Vernon, Oliver, Salmon Arm, Enderby and Celista.

The Commission received interventions in support of this application including letters from the Mayor of the District of Sicamous and the Sicamous Chamber of Commerce requesting confirmation that their community will be adequately served by the CBC's transmitters.

The applicant's reply

In response, the CBC stated that it had designed the coverage of the new transmitters to duplicate and, where possible, improve the coverage currently provided to these communities by its affiliate CHBC-TV Kelowna. The CBC added that it could not confirm exactly the level of coverage the new transmitters would provide to all of the affected communities until the installation of the transmitters is completed. The CBC confirmed that it would undertake tests of the coverage and attempt to correct any significant gaps in coverage.

Issuance of the licence

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department of Industry (the Department) notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Given that the technical parameters approved in this decision for the transmitters in Braeloch and Celista are for low-power unprotected television services, the Commission also reminds the licensee that it will have to select other channels if the Department so requires.

The transmitters must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 28 February 2007. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before this date.

[] In two subsequent amendments to the application, the CBC amended its original proposal by deleting the request to add a transmitter in Canoe, and by changing the transmitter site in Myra to Braeloch. The change from Myra to Braeloch was requested by the Department of Industry (the Department) because the community of Myra is located outside the service contours of the proposed transmitter.
[] The CBC had proposed a transmitter power of 18 watts, but the Department certified 100 watts.
