CFMX-FM-1 Toronto - Technical change

  The Commission approves the application by Trumar Communications Inc. to change its authorized contours.
 

The application

1. The Commission received an application by Trumar Communications Inc. to change the authorized contours of the radio programming undertaking CFMX-FM-1 Toronto, by increasing the average effective radiated power (ERP) from 13,300 watts to 24,500 watts.
2. The licensee stated that the proposed changes would result in a better quality signal by reducing adjacent channel interference and by strengthening the signal reception in certain areas.
 

Interventions

3. The Commission received several interventions supporting the application and one opposing intervention from Robert Kanis. Mr. Kanis raised concerns related to interference, including that an increase in CFMX-FM-1's ERP would result in an increase in adjacent channel interference to WJYE Buffalo.
4. The applicant did not respond to the intervention.
 

Commission's analysis and determination

5. In its evaluation of the application, the Commission has considered the views of the applicant and of the intervener and concludes that the proposed technical change is intended to improve the signal reception quality of CFMX-FM-1. The Commission is satisfied that this amendment is in the public interest. The issue of interference raised by the intervener will be looked at by the Department of Industry (the Department) in the context of issuing the broadcasting certificate.
6. Accordingly, the Commission approves the application by Trumar Communications Inc. to change the authorized contours of the radio programming undertaking CFMX-FM-1 Toronto, by increasing the average effective radiated power from 13,300 watts to 24,500 watts.
7. The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.
