In the Appendix to New multilingual ethnic television station to serve Toronto, Broadcasting Decision CRTC 2002-82, 8 April 2002 (Decision 2002-82), the Commission established the following condition of licence with respect to descriptive video (also known as described programming or described video programming) in connection with the approval in part of the application by Rogers Broadcasting Limited (Rogers) for a new ethnic television station, now known as OMNI.2.

15. During the 2002-2003 and 2003-2004 broadcast years, the licensee shall devote a minimum of 2 hours of programming during each broadcast month to the broadcast of programs with descriptive video. Beginning in the 2004-2005 broadcast year, at least 3 hours per month of descriptive video shall be provided. Beginning in the 2006-2007 broadcast year, at least 4 hours per month of descriptive video shall be provided. Over the licence term, 50% of the described programming shall be original programming.

In CHNU-TV Fraser Valley, CIIT-TV Winnipeg - Acquisition of assets, new transmitter in Victoria, and new licences, Broadcasting Decision CRTC 2005-207, 20 May 2005 (Decision 2005-207), the Commission stated at paragraph 89:

Rogers' applications did not include commitments to described programming on CHNU-TV and CIIT-TV, although at the public hearing, Rogers agreed to the application of conditions of licence related to described programming at the same level as those for its Toronto television station OMNI.2. Conditions of licence to this effect are set out in Appendix 1 to this decision.

The following wording was inadvertently used in Appendix 1 to Decision 2005-207 to define the conditions of licence for CHNU-TV Fraser Valley and CIIT-TV Winnipeg with respect to described video programming (condition of licence 11):
|

11. The licensee shall broadcast, between 7:00 p.m. and 11:00 p.m., the following amounts of described video programming:
|
|
|
a) in years 1 and 2 of the licence term, an average of two hours per week;
|
|
|
b) in years 3 and 4 of the licence term, an average of three hours per week; and
|
|
|
c) in year 5, and for the remainder of the licence term, an average of four hours per week.
|
|
|
In fulfilling this condition, a minimum of 50% of the required hours must be original broadcasts and all of the programming must be Canadian. Further, the licensee may broadcast up to one hour per week of described children's programming at an appropriate children's viewing time.

The Commission hereby corrects condition of licence 11 set out in Appendix 1 to Decision 2005-207 for CHNU-TV Fraser Valley and CIIT-TV Winnipeg to read as follows and, thereby, make it consistent with the condition of licence applicable to OMNI.2 set out in the Appendix to Decision 2002-82:
