  Application by 3216195 Canada Inc. to renew the licence of the national English-language direct-to-home (DTH) pay-per-view television programming undertaking known as "Rogers Sportsnet PPV-DTH", expiring 28 February 2005.
  The licensee proposes to amend the condition of licence which prohibits it from distributing programming, other than filler programming, produced by the licensee or a person related to the licensee. The proposed amendment would allow it to distribute programming produced by the licensee or a person related to the licensee. The licensee states that if the Commission is of the view that the proposed condition be restricted, the licensee would agree that a maximum of 50% of the total hours of programming made available by it, would be produced each year by the licensee or a person related to it.
  The licensee also proposes to amend the condition of licence which restricts the commercial messages contained in the programming it packages for distribution by licensed DTH distribution undertakings to those contained in the live feed of out of market programming in the category of sports. The licensee proposes to be subject by condition of licence to the Pay Television Regulations 1990 provision which prohibits the distribution of programming that contains any commercial message.
