Broadcasting Public Notice CRTC 2004-59

Ownership applications granted approval

  In this notice, the Commission publishes a list of transfers of ownership and changes to the effective control of broadcasting undertakings that it has authorized during the period 1 May 2004 to 30 June 2004 pursuant to its streamlined procedure.

The Commission has a streamlined procedure for its consideration of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings. Under this procedure, and on a case-by-case basis, the Commission may approve such an ownership application without first having issued a public notice provided that:
 

a) its examination of the application reveals the presence of no significant policy concern; and

 

b) the Commission is convinced that approval would be consistent with its approvals of previous applications.

Where these two conditions are met, the Commission is generally satisfied that a process initiated by a public notice is not required in the public interest, and would unnecessarily delay implementation of the transaction contemplated by the applicant.

The Commission intends to issue a public notice, every two months or as circumstances may otherwise warrant, listing all transfers of ownership and changes in effective control that it has authorized pursuant to its streamlined procedure. In the appendix to this public notice, the Commission sets out details regarding the ownership transactions that it has authorized during the period 1 May 2004 to 30 June 2004.

28 May 2004 		Change of control effected through the acquisition of 50.9% of the voting rights of the licensee, by Golden West Broadcasting Ltd., a corporation ultimately controlled by Mr. Elmer Hildebrand.

2.

VDN Cable Inc. 2004-0461-6
8 June 2004 		Change of control as a result of an issuance of shares in order to raise funds causing the ownership of the licensee to change. The principal shareholders are Philip Gale (28.72%), Gas Metropolitain Plus Limited Partnership (20.57%), Myrtle Gale (18.94%) and Moi-Meme Investments Inc. (10.73%).

CJAV Limited 2004-0490-6
25 June 2004 		Change of control effected through the transfer of all of the issued and outstanding shares of the licensee to Central Island Broadcasting Limited.

Image Wireless Communication Inc. 2004-0533-3
30 June 2004 		Change of control effected through the transfer of all of the issued and outstanding shares of the licensee to YourLink Incorporated, a corporation controlled by the Kumar family.
