Call for responses to submissions on the Canadian Cable Telecommunications Association's proposal to amend the policy regarding the use of local availabilities |

The Commission calls for responses to the submissions received pursuant to Proposal by the Canadian Cable Television Association to amend the policy regarding the use of local availabilities - Call for comments, Broadcasting Public Notice CRTC 2004-47, 9 July 2004. In that public notice, the Commission sought comments on issues related to a proposal by the Canadian Cable Telecommunications Association (formerly known as the Canadian Cable Television Association) to amend the policy regarding the use of local availabilities. | |
1. | The Canadian Cable Telecommunications Association (formerly known as the Canadian Cable Television Association) (CCTA) requested that the Commission amend its policy regarding the use of the local availabilities contained in the programming of U.S. satellite services. Under the CCTA's proposal, a Canadian cable broadcasting distribution undertaking (BDU), upon approval of an application, would be permitted to use these local availabilities to distribute commercial advertising messages, as well as messages promoting affiliated services offered by the cable undertaking. The CCTA specified that 25% of the additional revenues earned by a cable BDU from the proposed use of the local availabilities would be directed to the Canadian Television Fund. |
2. | In Proposal by the Canadian Cable Television Association to amend the policy regarding the use of local availabilities - Call for comments, Broadcasting Public Notice CRTC 2004-47, 9 July 2004 (Public Notice 2004-47), the Commission set out a number of questions on the CCTA's proposal and on the impact that approval of the proposed policy amendments could have on the Canadian broadcasting system. The Commission stated that it would accept submissions that were received on or before 7 October 2004. In addition, the Commission indicated that it would call for further submissions if it considered that additional information was necessary. |
3. | In response, the Commission received some 38 submissions. Some of these submissions included extensive comments, studies and proposals to address the issues and questions set out in Public Notice 2004-47. The submissions that were filed in electronic form are available on the Commission's web site at www.crtc.gc.ca, but only in the official language and format in which they are submitted, and may be accessed in the Public Proceedings section of the CRTC web site. Copies of all submissions filed in response to Public Notice 2004-47, whether filed on paper or in electronic form, are available on the public examination file. |
4. | The Commission wishes to ensure that these issues receive the broadest possible examination. Accordingly, the Commission has decided to provide interested parties with the opportunity to comment on the submissions received in response to Public Notice 2004-47. The Commission therefore invites comments that respond to these submissions. The Commission will accept the comments that it receives on or before 21 February 2005. |

The Commission will not formally acknowledge comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out below have been followed. |
