People's Telephone Company of Forest Inc.

Transfer of responsibility for inside wire

1.

The Commission received an application by People's Telephone Company of Forest Inc. (People's), dated 23 August 2002 to introduce item 7, Connection of Primary Exchange Service to Inside Wire and Jacks, to section 100 of its General Tariff.

In its application, People's proposed to:
 
  • transfer the responsibility for the installation, maintenance and repair of inside wiring to its customers;
 
  • continue to maintain inside wire associated with hardwired telephone connections free of charge until such time as these connections are converted to jacks; and
 
  • not assess a diagnostic maintenance charge if a reported trouble is determined to be associated a customer's inside wiring if that customer is without a jack-ended demarcation device.

The Commission received no comments with respect to the application.

The Commission notes that it has approved several other telephone companies' applications requesting the transfer of responsibility for inside wiring to their customers in instances where:
 
  • subscribers are given notice of the proposal;
 
  • if subscribers are to take responsibility for the installation and maintenance of inside wiring, the telephone company makes available to subscribers a wiring guidesetting out the specifications and other information, including any references to relevant building codes or industry standards, in sufficient descriptive detail to permit the safe installation of typical inside wiring; and
 
  • along with the transfer of responsibility for inside wiring, the telephone company transfers the terminal equipment assets to the non-monopoly sector, thereby reducing the company's revenue requirement.

In Regulatory framework for the small incumbent telephone companies, Decision CRTC 2001-756, 14 December 2001 (Decision 2001-756), the Commission established a new regulatory framework that focused on prices rather than earnings.

Moreover, in Decision 2001-756, the Commission implemented the national total subsidy requirements calculation methodology, replacing the former rate of return subsidy calculation.

Accordingly, the Commission notes that it has relieved the companies subject to Decision 2001-756 from the requirement to calculate their shortfall subsidy on a rate of return basis. In light of the above, the Commission no longer considers it appropriate to require the transfer of terminal equipment assets to the non-monopoly sector.

The Commission approves People's application. The proposed tariff revisions, filed under Tariff Notice 43, take effect six months from the date of this order. People's is to forthwith issue revised tariff pages.

The Commission directs People's, within 60 days from the date of this order: 
  a) to make available a wiring guide providing subscribers with specifications for the installation of inside wiring from the demarcation point up to and including telephone jacks, including any references to relevant building codes or industry standards. The guide is to provide sufficient descriptive detail to permit a subscriber to safely install typical inside wiring; and
  b) to notify subscribers of this order via a billing insert/letter.

The Commission further directs People's to submit within 10 days from the date of this order, for the Commission's review, the content of the billing insert/letter to be sent to subscribers. The insert/letter is to state clearly that: 
  a) effective six months from the date of this order, subscribers will be responsible for and have authority over inside wiring, whether installed by People's, a landlord or the subscriber, and may either do any installation or repair work themselves or have it performed by People's or a third party;
  b) as of the date of the insert/letter, the company will make a wiring guide providing subscribers with specifications for the installation of inside wiring from the demarcation point up to and including telephone jacks, including any references to relevant building codes or industry standards. The guide will provide sufficient descriptive detail to permit a subscriber to safely install typical inside wiring available to subscribers upon request; and
  c) People's will install, extend, move or repair inside wiring, at the tariffed rates in effect as of the date of this order, for subscribers who so request prior to six months from the date of this order, even if the work is not completed until a later date.
