Aliant Telecom Inc.

Migration of DMS data service to the Aliant Telecom General Tariff

1.

The Commission received an application by Aliant Telecom Inc. (Aliant Telecom), dated 14 November 2003, proposing to migrate the following tariff items to Aliant Telecom's General Tariff item 500, DMS Data Service:
 
  • Island Telecom Inc.'s (Island Tel) Supplementary Tariff, DMS Data section, pages 73 to 78, in part;
 
  • Maritime Tel & Tel Limited's (MTT) Supplementary Tariff, DMS Data section, pages 81 to 85, in part;
 
  • NBTel Inc.'s General Tariff item 235; and
 
  • NewTel Communications Inc.'s General Tariff item 195.

Aliant Telecom proposed that, for Nova Scotia and Prince Edward Island (PEI), the company would migrate only the non-Centrex components of the DMS data service tariff provisions to its General Tariff and withdraw the Centrex components of the DMS data service. Aliant Telecom noted that the tariff provisions associated with the Centrex component of the DMS data service were also in MTT General Tariff items 780 and 970, and Island Tel General Tariff item 698.

Aliant Telecom also proposed not to include a reference to Digital Data Units in the proposed tariff given that Digital Data Units are terminal equipment and are forborne from regulation.

Aliant Telecom, in a letter dated 12 December 2003, provided additional information with respect to the proposed tariff provisions for service charges in Nova Scotia and PEI and proposed to withdraw the tariff provisions and rates associated with Digital Data Network Connection and Modem Pool (Network Resource Element) options.

In its 12 December 2003 letter, Aliant Telecom noted that the DMS data service tariffs for Nova Scotia and PEI did not specify an explicit service charge in relation to the installation of the digital data loop. Aliant Telecom noted that the tariff did refer to the "Service Charge Section of Handbook" and submitted that all customers have been charged for the installation of DMS data digital loop according to the Standard Service Charge Schedule. Aliant Telecom stated that it included the direct reference to the Standard Service Charge in the proposed new tariff and submitted that there is no rate change for customers.

In the above noted letter, Aliant Telecom also proposed to withdraw the tariff provisions for the Digital Data Network Connection and Modem Pool (Network Resource Element) options associated with Non-Centrex DMS data service as there are currently no customers using the service. Aliant Telecom noted that these services would still be available under the Centrex tariffs at the same rates.

The Commission received no comments with respect to the application.

The Commission notes that there are no changes to the rates for DMS data service.

The Commission notes Aliant Telecom's proposal to remove from its tariff, Digital Data Units, which are described as standalone AC powered equipment modules that exist at the client's premise. The Commission further notes that in Review of regulatory framework, Telecom Decision CRTC 94-19, 16 September 1994, it forbore from regulating the lease and maintenance of competitive terminal equipment. Accordingly, the Commission considers that Aliant Telecom's proposal to remove Digital Data Units from its tariff is appropriate.

The Commission notes Aliant Telecom's proposal to withdraw the tariff provisions associated with Centrex DMS data service, and Non-Centrex Digital Data Network Connection and Modem Pool (Network Resource Element). Aliant Telecom stated that there are no customers for Non-Centrex Digital Data Network Connections and Modem Pool (Network Resource Element) and that tariff provisions for these elements and for Centrex DMS Data Service exist in MTT General Tariff items 780 and 970, and Island Tel General Tariff item 698. Accordingly, the Commission considers Aliant Telecom's proposal to withdraw these tariff provisions appropriate.

In light of the above, the Commission approves Aliant Telecom's application. The revisions take effect as of the date of this order.
