Provision of Ethernet Access service

The Commission received an application by Prince Rupert City Telephones (CityTel), dated 12 July 2004 and amended on 30 August 2004, 28 September 2004 and 1 November 2004, proposing revisions to its General Tariff under section 8, Special Services, to introduce item 11, Ethernet Access Service, in order to provide network access facilities for customer wide area network services between CityTel's serving central office and the customer's premises.

CityTel indicated that its proposed Ethernet Access service was similar, in regards to pricing and conditions of service, to Bell Canada's Ethernet Access service as approved on an interim basis in Ethernet services, Telecom Decision CRTC 2004-5, 27 January 2004, with respect to its 10 Mbps service offering.

CityTel further indicated that its proposed Ethernet Access service was similar, in regards to pricing and conditions of service, to TELUS Communications Inc.'s Ethernet Access service as approved on an interim basis in TELUS Communications Inc. - Provision of Ethernet access service and OC-3 digital network access service, Telecom Order CRTC 2002-456, 10 December 2002, with respect to its 100 and 1000 Mbps service offerings, its Service Link charge and its Duplex Mode-Change service charge.

In Regulatory framework for the small incumbent telephone companies, Decision CRTC 2001-756, 14 December 2001 (Decision 2001-756), the Commission determined that the fourth basket of capped services would comprise all other services offered by the small incumbent local exchange carriers, such as optional services, multi-element service categories, special facilities tariffs and competitor access tariffs. It also determined that rates for these services would generally be permitted to increase up to any already approved rate for the same service. It stated that tariff applications could be submitted at any time and should reference when and where the Commission approved the rate.

The Commission finds that CityTel's proposed rates are in line with the determinations in Decision 2001-756.

In light of the above, the Commission approves on interim basis CityTel's application. The revisions take effect as of the date of this Order.

CityTel is to issue revised tariff pages forthwith to reflect these changes.
