Interconnection rates |

1. |
The Commission received an application by Globility Communications Corporation (Globility), dated 19 August 2004, to revise the following General Tariff items: |

Globility requested that the proposed revisions take effect as of 1 June 2004. |

The Commission received no comments with respect to the application. |

In Local competition, Telecom Decision CRTC 97-8, 1 May 1997, the Commission determined that it was in the public interest to require competitive local exchange carriers (CLECs) to provide interconnection to all interexchange service providers and wireless service providers, at terms and conditions that are equivalent to those contained in the incumbent local exchange carriers' (ILECs') tariffs. The Commission required all CLECs to file proposed tariffs for interconnection, justifying any departure from the terms and conditions contained in the ILECs' tariffs. |

The Commission notes that Globility proposed the revisions in order to reflect the lower interconnection rates effective 1 June 2004, which were issued by the ILECs pursuant to Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002. The Commission finds that the rates conform to the ILECs' rates that were in effect on 1 June 2004. |

The Commission notes that, for services that Globility does not plan to offer in a specific territory, Globility has used the notation "[FILE]" in its General Tariff instead of indicating that this service is not offered. The Commission further notes that the notation "[FILE]", which is used in the CLEC Model Tariff, indicates that a CLEC could file a proposed rate for a specific service if it is the CLEC's intention to offer that service. Where a CLEC does not plan to offer a specific service, the notation "[FILE]" should be replaced with an appropriate notation to indicate that the specific service will not be offered. |

In light of the above, the Commission approves on an interim basis, Globility's proposed rates. The Commission, however, directs Globility to replace every occurrence of "[FILE]" with "N/A", or some other appropriate notation. |

The rates take effect as of 1 June 2004. |

The Commission directs Globility to issue forthwith revised tariff pages reflecting the changes specified above. |
