Revised interconnection rates

1.

The Commission received an application by EastLink, dated 16 December 2003, and amended on 17 December 2003 and 4 May 2004, to revise the interconnection rates in the following General Tariff items:
 
  • Part B, Interconnection with Local Exchange Carriers
 

-item 201, Compensation for Traffic Termination

 
  • Part C, Interconnection with Interexchange Service Providers (IXSPs)
 

-item 302, Trunk-side Access

 

-item 303, Network Announcements for Customers of Disconnected IXSPs with Trunk-side Access

 

-item 304, Bulk Transfer of End-Customer Base Between IXSPs

 

-item 305, Billing and Collection Service

 
  • Part D, Interconnection with Wireless Service Providers
 

-item 402, Trunk-side Access

EastLink proposed the adoption of the rates contained in version 20 of the competitive local exchange carrier (CLEC) model tariff (Model Tariff) with some modifications. Specifically, EaskLink departed from the Model Tariff:
 

i) where certain items in the Model Tariff did not provide rates for the provinces of Nova Scotia, New Brunswick or Prince Edward Island; and

 

ii) where the rates in EastLink's existing tariff were lower than the rates contained in the Model Tariff.

The Commission received no comments with respect to the application.

 

Background

In Local competition, Telecom Decision CRTC 97-8, 1 May 1997, the Commission considered that it was in the public interest to require CLECs to provide interconnection for wireless service providers and equal access for all interexchange service providers, at terms and conditions equivalent to those contained in the incumbent local exchange carriers' (ILECs') tariffs. The Commission required all CLECs to file proposed tariffs for interconnection and to justify any departure from the terms and conditions contained in the ILECs' tariffs.

In Amendments to EastLink General Tariff, Telecom Order CRTC 2002-165, 18 April 2002, the Commission approved service charges for EastLink including item 403.9, Transfer of Entire NXX, which reflected the ILEC's service charge that was in effect at that time in the operating territory of Ontario and Quebec.

In Model tariff for the interconnection services of competitive local exchange carriers, Telecom Decision CRTC 2002-54, 3 September 2002, the Commission directed all CLECs to adopt the Model Tariff for their general tariffs. Further, the Commission directed all CLECs to file tariffs that reflected the relevant terms, conditions and rates of the Model Tariff.

 

Commission analysis and determination

In Tariff for the interconnection services of competitive local exchange carriers, Telecom Order CRTC 2003-187, 12 May 2003, the Commission approved EastLink's General Tariff which reflected the relevant terms, conditions and rates of the Model Tariff.

In Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002, the Commission directed each ILEC to issue tariff pages by 1 June of each year incorporating adjustments to Category I Competitor Service rates to reflect the application of the constraint of inflation less the productivity offset. On 1 June 2003, the ILECs issued tariff pages reflecting a reduction to, among other rates, the service charge for Transfer of Entire NXX.

The Commission notes that the Model Tariff contains terms and conditions equivalent to those of the ILEC's tariffs for each relevant operating territory. The Commission further notes that CLECs are required to justify any proposed departures from the Model Tariff when filing tariff revisions.

The Commission notes that the majority of the revised interconnection rates proposed by EastLink in Tariff Notices 11, 11A and 11B, are consistent with the interconnection rates approved for the ILECs which were effective from 1 June 2003 to 31 May 2004 and were reflected in version 20 of the Model Tariff.

However, the Commission notes that in its application, EastLink has not reflected the ILEC's service charge for Transfer of Entire NXX in Ontario and Quebec that was in effect starting 1 June 2003. The Commission further notes that EastLink did not provide any justification for deviating from this service charge. Accordingly, the Commission finds that the service charge should be reduced to match the ILEC's service charge for this service that was in effect starting 1 June 2003 for Ontario and Quebec as reflected in version 20 of the Model Tariff.

In light of the above, the Commission approves on an interim basis, EastLink's proposed service charge, subject to the company incorporating the amendment to item 403.9, Transfer of Entire NXX, identified below:
 
  • replace the service charge of $2,002.54 with $2,002.24 for New Brunswick, Nova Scotia and Prince Edward Island.

The proposed rates take effect 1 June 2003. The Commission directs EastLink to issue forthwith revised tariff pages reflecting the changes specified above.
