Telecom Order CRTC 2004-160

  Ottawa, 13 May 2004

TELUS Communications Inc.

  Reference: Tariff Notices 134, 134A and 134B

Customer-specific arrangement

1.

The Commission received an application by TELUS Communications Inc. (TCI), dated 12 January 2004 and amended on 25 March 2004 and 28 April 2004, to introduce Special Facilities Tariff item 688, Data Transmission - Flat Rate Low-Speed Data Network service.

2.

TCI stated that the proposed service is a customer-specific arrangement (CSA), consisting of a bundle of services that would connect the customer's host computer located in British Columbia to the customer's remote terminals located throughout British Columbia.

3.

TCI submitted that the proposed service met the conditions established by the Commission for Type 2 CSAs in Bundling framework developed for customer-specific arrangements, Order CRTC 2000-425, 19 May 2000 (Order 2000-425).

4.

The Commission is of the preliminary view that TCI's application satisfies the requirements, including the imputation test, of Order 2000-425 for a Type 2 CSA.

5.

In light of the above, the Commission approves on an interim basis TCI's application. The revisions take effect as of the date of this order.
