  The purpose of this transaction is to transfer the specialty service known as ResponseTV from IBDG, Inc., a corporation owned and controlled by Beverley Milligan to a new corporation (ResponseTV, Inc.), also owned and controlled by Beverley Milligan. The ultimate control of ResponseTV would therefore remain unchanged if this transaction is approved.

  The licensee proposes to change the frequency of its transmitter from 92.3 MHz (channel 222LP) to 91.3 MHz (channel 217B1). The licensee also proposes to change its authorized contours byincreasingthe effective radiated power from 50 watts to 3,400 watts, by increasing the antenna height and by relocating the transmitter (non-directional antenna/antenna height of 164.1 metres).
  The transmitter would be relocated to a site approximately 16.5 kilometres northwest from the current site and the antenna height would increase from 36 metres to 164.1 metres.
  The licensee wishes to increase the quality of the signal of the station.
  Under this proposal, the status of CJLX-FM would change from a low power unprotected service to a regular Class B1 FM station.

  The applicant is also requesting a licence to operate this undertaking under the same terms and conditions as those specified in Decision 2003-615. The applicant would need to meet the requirements for the issuance of a licence, set out in that decision, before a licence could be issued for this undertaking.
  Newcap has advised that the application approved in Decision 2003-615 had, in error, been filed on behalf of its subsidiary instead of on its own behalf. It has submitted the current application to correct this error.
  The undertaking is not yet in operation and the Commission has not issued the licence for this undertaking because the requirements for the issuance of the licence have not yet been met.
