Re: Application by Maskatel inc. to lift restrictions on the provision of retail digital subscriber line Internet services

On 12 February 2004, the Commission received an application from Maskatel inc. (Maskatel), filed under Part VII of the CRTC Telecommunications Rules of Procedure (the Rules).

The Commission also received submissions concerning the above application from TELUS Communications Inc. and TELUS Communications (Quebec) Inc. (TELUS), on 5 March 2004, from FCI Broadband, a division of Futureway Communications Inc. (FCI Broadband), on 10 March 2004 and from 4089316 Canada Inc. operating commercially as Xit télécom (Xit télécom), on 12 March 2004.

Staff notes that section 57(2)(b) of the Rules provides that applications under Part VII are required to:

    contain a clear and concise statement of the facts upon which the applicant relies, and any  other information required to inform the Commission of the nature, purpose and extent of the application.

Staff is of the view that the Maskatel application does not meet the minimum requirements for Part VII applications. Specifically, staff considers that Maskatel did not provide sufficient particulars and supporting information to allow interested parties to respond adequately to Maskatel's application for relief.

Consequently, the Maskatel application is rejected as filed.

As regards the submissions from TELUS, FCI Broadband and Xit télécom concerning this application, since the application is rejected, the submissions are moot.

This matter is closed.
