Dear Sir/Madam:
This letter constitutes the Commission's decision in relation to the remaining procedure for the proceeding initiated by PN 2003 10.
Given the nature of the issues in this proceeding and of the evidence filed, the Commission considers that a paper process is sufficient to provide the parties with a meaningful opportunity to challenge the evidence filed and to participate in this proceeding. As established in PN 2003 10 and as set out below, the paper process in this proceeding involves the filing of evidence, the opportunity to address written interrogatories, and the submission of written final argument and reply argument. The Commission has therefore determined that an oral component to this proceeding will not be required.
The Commission also notes in passing that an oral hearing would involve an enormous expenditure of resources, both human and financial, on the part of all parties including the Commission and would extend the proceeding.
In light of the foregoing, the remaining procedure in relation to PN 2003 10 is hereby established as follows:
1. A determination will be issued with respect to requests for further information and public disclosure as soon as possible. Any information to be provided pursuant to that determination will be required to be filed with the Commission and served on all parties by 30 April 2004.
2. Parties may file final argument with the Commission, serving a copy on all other parties, by 17 May 2004.
3. Parties may file final reply comments with the Commission, serving a copy on all other parties, by 31 May 2004.
All documents must actually be received, not merely sent, by the dates indicated.
