Response TV - Acquisition of assets

1.

The Commission approves the application by ResponseTV, Inc. to acquire from IBDG, Inc. the assets of the English-language Category 2 specialty programming undertaking approved in Response TV - Category 2 specialty service, Broadcasting Decision CRTC 2002-343, 6 November 2002 (Decision 2002-343). The applicant also requested a broadcasting licence to operate the service to be known as Response TV under the same terms and conditions as those specified in Decision 2002-343.

The Commission did not receive any interventions in connection with this application.

This transaction will not result in any change in the effective control of the undertaking, which will remain under the ultimate control of Beverley Milligan.

The Commission has not issued a broadcasting licence for this undertaking because the requirements for the issuance of the licence have not yet been met. A licence will be issued once the applicant has satisfied the Commission, with supporting documentation, that the following requirements have been met:
 
  • the applicant has entered into a distribution agreement with at least one licensed distributor; and
 
  • the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 6 November 2005, unless a request for an extension of time is approved by the Commission before that date. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.

The licence will expire 31 August 2009, the same expiry date as that set out in Decision 2002-343, and will be subject to the same terms and conditions as those specified in that decision.

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
