The Commission approves the application by Newcap Inc. for authority to acquire from 3937844 Canada Inc., a subsidiary of Newcap Inc., the assets of the new FM radio programming undertaking approved in FM radio station in Camrose, Broadcasting Decision CRTC 2003-615, 19 December 2003 (Decision 2003-615).1 |

The applicant stated that it filed the present application in order to correct the error it had made in the original application, approved in Decision 2003-615, which should have been filed on behalf of Newcap Inc., not on behalf of its subsidiary 3937844 Canada Inc. |

The Commission did not receive any interventions in connection with the present application. |

The Commission has not yet issued a broadcasting licence for this undertaking because the requirements for the issuance of the licence have not yet been met. As stated in Decision 2003-615, pursuant to section 22(1) of the Broadcasting Act, no licence may issued until the Department of Industry notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued. Furthermore, the licence will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. |

The licence will expire 31 August 2010, the same expiry date as set out in Decision 2003-615, and will be subject to the same terms and conditions as those specified in that decision. |

Because this licensee is subject to the Employment Equity Act and files reports concerning employment equity with theDepartment of Human Resources and Skills Development, its employment equity practices are not examined by the Commission. |
