CBU Vancouver - New transmitter in Abbotsford

  The Commission approves the application by the Canadian Broadcasting Corporation to amend the broadcasting licence for the radio programming undertaking CBU Vancouver in order to operate a transmitter in Abbotsford.
 

The application

The Commission received an application by the Canadian Broadcasting Corporation (CBC) to amend the broadcasting licence for the radio programming undertaking CBU Vancouver in order to operate a transmitter in Abbotsford. The proposed transmitter would operate at 101.7 MHz (channel 269A) with an effective radiated power (ERP) of 67 watts.

The CBC indicated that the new transmitter would provide a more reliable service in areas, within and around Abbotsford.
 

Interventions

3. 4. The Commission received four interventions in support of this application, and one in opposition from Ms Vern Pigou. She expressed concern about the potential for interference to her reception of CHLY Nanaimo by the CBC's proposed use of 101.7 MHz.
4. The CBC did not respond to Ms Pigou's intervention.
 

The Commission's analysis and determination

5. Based on its examination of the record, the Commission finds that the addition of the proposed transmitter in Abbotsford is in the public interest. With regard to the concern raised by Ms Pigou, the Commission notes that matters related to potential interference are subject to the Department of Industry (the Department). In the present case, the Department approved the CBC's application, as filed, subject to requirement that the technical parameters do not create any unacceptable interference with aeronautical NAV/COM services.
6. In light of the above, the Commission approves the application by the Canadian Broadcasting Corporation to amend the broadcasting licence for the radio programming undertaking CBU Vancouver in order to operate a transmitter in Abbotsford at 101.7 MHz (channel 269A) with an ERP of 67 watts.

The Department has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
8. The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.
9. The transmitter must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 7 September 2006. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before this date.
