The Commission received an application by Radio Nord Communications inc. (Radio Nord) for authority to acquire the assets of the radio programming undertaking CHLX-FM Ottawa/Gatineau from Groupe Radio RNC inc. The applicant also requested a broadcasting licence to continue the operation of this undertaking. |

In its application, the applicant stated that it wants to liquidate Groupe Radio RNC inc.'s assets and dissolve the company as part of an intra-corporate reorganization. Groupe Radio RNC inc.'s assets would be transferred to Radio Nord. |

According to the applicant, this transaction would not result in any changes to the effective control of the undertaking, which would remain under the ultimate control of Radio Nord. |

The Commission received an intervention by the Association québécoise de l'industrie du disque, du spectacle et de la vidéo (ADISQ). It asked the Commission to maintain the expiration date of the surrendered licence when the new licence is issued. ADISQ submitted that maintaining the expiration date of the licence will enable closer monitoring of the licence term and make it possible to better assess the pertinence of enforcing the regulations, in the interest of both the applicant and the public. |

The Commission's analysis and determination |

Based on the fact that this transaction will not change the ultimate control of the licensee, the Commission approves the application by Radio Nord Communications inc. to acquire the assets of the radio programming undertaking CHLX-FM Ottawa/Gatineau, and obtain a broadcasting licence to continue the operation of this undertaking. |

The Commission has noted ADISQ's concerns that the expiration date of the surrendered licence be maintained when a new licence is issued in the context of an intra-corporate reorganization. |

The Commission will issue a licence to Radio Nord Communications inc. for the remainder of the licence term of CHLX-FM Ottawa/Gatineau, expiring 31 August 2008, upon the surrender of the current licence to the Commission. The licence will continue to be subject to the terms and conditions set out in New classical music FM station in Ottawa/Hull, Decision CRTC 2001-626, 4 October 2001. |
