The Commission received an application by Westport Telephone Company Limited (Westport), dated 16 September 2002, to remove the Internet Access Service item from section 900 of its General Tariff.

In Forbearance from retail Internet services, Telecom Order CRTC 99-592, 25 June 1999, the Commission determined that it would be appropriate to forbear from regulating retail Internet Services (IS) provided that a company separates retail IS assets, revenues and expenses from its rate base and shortfall subsidy calculation.

In Regulatory framework for the small incumbent telephone companies, Decision CRTC 2001-756, 14 December 2001 (Decision 2001-756), the Commission established a new regulatory framework that focused on prices rather than earnings.

Moreover, in Decision 2001-756, the Commission implemented the national total subsidy requirements calculation methodology, replacing the former rate of return subsidy calculation.

Accordingly, the Commission notes that it has relieved the companies subject to Decision 2001-756 from the requirement to calculate their shortfall subsidy on a rate of return basis. In light of the above, the Commission considers it appropriate to forbear from regulating Westport's retail IS service without requiring Westport to separate its retail IS assets, revenues and expenses from its rate base and shortfall subsidy calculation.

The Commission received no comments with respect to the application.

The Commission approves Westport's application. The revisions take effect as of the date of this order.

Westport is to issue revised tariff pages forthwith to reflect this change.
