Re: Retail quality of service rate adjustment plan and related issues, Telecom Public Notice CRTC 2003-3 - Request for modification of schedule

This letter is in response to a request dated 20 June 2003 by the Consumers' Association of Canada, the National Anti-Poverty Organization, and l'Union des consommateurs ("the Consumer Groups") for modification to the schedule of the proceeding initiated by Telecom Public Notice CRTC 2003-3 (PN 2003-3) dated 27 March 2003.

The Consumer Groups requested a one week extension to the current deadline for filing of Requests for Disclosure and Further Responses, from August 18th to August 25th. The Consumer Groups indicated that their proposed extension was needed in order to accommodate previously arranged summer holidays. The Consumer Groups further submitted that if other extensions are required, (e.g., to the deadline for responses to such requests), the Consumer Groups have no objection to such extensions.

Aliant Telecom Inc., Bell Canada, MTS Communications Inc., Saskatchewan Telecommunications and Télébec, Limited Partnership (collectively, the Companies) submitted that the timelines for this proceeding were set out in Public Notice 2003-3 and that such notice should have been sufficient for the Consumer Groups to arrange its summer holidays accordingly.

The Companies added that, to modify the schedule as requested by the Consumer Groups may, in turn, jeopardize the holidays of other parties who have planned their vacation around the timelines set out in PN 2003-3. The Companies would not object to the extension requested by the Consumer Groups if a one week extension, from August 5th until August 12th, is also granted for the filing of interrogatory responses. The Companies submitted that this would result in the thirteen day period between the filing of interrogatory responses and the filing of Requests for Disclosure and Further Responses, as provided for in PN 2003-3, being preserved.

The Companies further submitted that if the extension requested by the Consumer Groups is granted, then the deadline for all subsequent milestones must also be extended by one week.

Staff considers that the Consumer Groups' proposal to modify the date for the filing of Requests for Disclosure and Further Responses from August 18th to August 25th, is reasonable, as is the Companies' request for a one week extension for the filing of interrogatory responses.
The process as set out in PN 2003-3 is amended as follows:

Paragraph 22:

Responses to interrogatories are to be filed with the Commission and served on all parties, by 12 August 2003.

Paragraph 23:

Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the party or parties in question, by 25 August 2003.

Paragraph 24:

Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by
9 September 2003.

Paragraph 25:

A determination will be issued with respect to requests for further information and public disclosure as soon as possible. Any information to be provided pursuant to that determination will be required to be filed with the Commission and served on all parties by 7 October 2003.

Paragraph 26:

Parties may file argument with the Commission on any matters within the scope of this proceeding, serving a copy on all other parties by 21 October 2003.

Paragraph 27:

Parties may file reply arguments with the Commission, serving a copy on all other parties by 4 November 2003.


Staff reminds parties that where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
