Deadline to commence operation of Category 2 specialty and pay television services

  In this decision, the Commission extends the deadline to commence operation of the Category 2 specialty and pay television services listed in the appendix until 24 November 2004.
 

Background

The Commission approved the applications to operate the Category 2 specialty and pay television services listed in the appendix on 24 November 2000. It set out its reasons for their approval as well as the terms and conditions of licence for those services in Introductory statement - Licensing of new digital pay and specialty services, Public Notice CRTC 2000-171, 14 December 2000 (Public Notice 2000-171).

In Public Notice 2000-171, the Commission granted applicants for Category 2 specialty and pay services three years to implement their services, i.e., no later than 24 November 2003, unless the Commission approved an extension to this deadline, given that, as of the date of approval, licensees of such services were not assured of digital access in the short term. Approximately 40 of the Category 2 services approved in November 2000 are now in operation. The applicants for the services set out in the appendix submitted, before the prescribed deadline, applications to extend the implementation date for their services.
 

The Commission's decision

The Commission notes that the deadline of three years that was granted for the implementation of these services is longer than the 24 months that is generally granted. The Commission also notes that digital penetration has increased significantly since the services in question were approved, and that the distribution of Category 2 services has evolved in a positive manner. In light of the above, the Commission approves a final extension to the implementation date for these services, and extends to 24 November 2004 the deadline to commence operation of the Category 2 specialty and pay television services set out in the appendix to this decision. The licences will not be issued, unless the licensees have commenced operating their respective services by no later than 24 November 2004. The Commission reminds the applicants that they must also respect the terms set out in the appendix 2 of Public Notice 2000-171.
